Refusal to refund:

complaint of bad business practices against Pre & Press Consultants Inc., Pre-Press Consultants Inc., Pressroomhelp, pressroomhelp.com, and Jerry Huffman, President, of Orange, CA (10/9/2009)-

the company refuses to refund and will not provide any evidence of any attempt to refund.

NOTE: this complaint is NOT against Prepress inc, or Prepress Consultants, Inc. of Keller Texas or Prepress Warehouse (prephelp) on eBay- they are a different company.

Our company bought a shrink-wrap machine for $1,000 from Mr. Huffman on eBay on February 23, 2009 and paid with Paypal, which was indicated as a payment option on Mr. Huffman's eBay advertisement.

Mr. Huffman then asked us to pay with a company check because he did not want to use Paypal anymore and promised to refund our Paypal payment promptly. Quite simple.

It is now six months later and Mr. Huffman has never refunded the payment via Paypal, has of course cashed our check to him, and responds to our e-mail requests for a refund with an escalating emotional debate followed by silence.

When asked for any evidence from Paypal that he has refunded the payment (simply a forwarded e-mail or Paypal statement), he refuses. Of course it his responsibility to make sure a refund is completed! It isn't a refund if it doesn't get back to the customer!

Here is the e-mail thread

Dear George Walsh,

Thank you for contacting PayPal. My name is Faye and I am glad to assist you today. If I understood you correctly, you are concerned with getting your money back, and I do apologize for the delay of your service request.

Hi George, upon checking your account, I do see that the case for the amount of $1,000.00 USD was closed. I provided the steps below to recover the funds.

To request a refund, contact the recipient of the payment. To locate the recipient's contact information:

1. Go to the PayPal website and log in to your account.
2. Click "History" at the top of the page.
3. Click the "Details" link of the transaction.

From the details, you are able to view the recipient's name or business name, email address, and customer service phone number, if available.

It is best to ask the recipient to use the "Refund" link when issuing your refund. The Refund link is available within the first 60 days of receiving a payment. Utilizing this link refunds the full amount of the payment back to your account or credit card, depending on which funding source was used; and the fees will not be assessed to either side.
Refunds posting to your credit card can take up to 30 days to process, depending upon your credit card issuer.

If you are unable to arrange a refund and you have not received your item, or the item is significantly not as described, you can open a dispute within 45 days of the payment.

Paypal confirms you were paid the $1000 and it was not returned. Can you return it now via Paypal, or, alternatively to us directly by check.

Jerry: Send me the email confirming the $1000.00 was returned to paypal, so I can finish this matter with them.

Thanks,

George Walsh

There were then a series of phone calls where we asked for a copy of the e-mail from paypal saying the money was refunded so we could straighten it out with Paypal.

Jerry Huffman refused...

Since you refuse to provide the e-mail from Paypal and asked us not to call you, we must simply conclude you stole the money.

If we do not receive a refund in five business days, we will 1) report your company to the Better Business Bureau, 2) file a complaint with eBay, 3) upload a statement of you and your company's bad business practice to our website which will show up in any Google search of your name and company, and 4) file a small claims action in the Orange County small-claims court.

Why can you not just forward your e-mail from paypal so we can follow it up with them? Just forward the e-mail... two minutes of your time....

That is all I am asking.... or ever asked.... for the tenth time.

A reasonable person would assume it is because you do not have it.

Where in OUR response from Paypal does it say we received our refund? Please point it out? Paypal confirms you were paid. We are initiating the complaint to BBB, eBay, webposting of the e-mail thread, and filing a small claims action against you personally and your company name, all tomorrow at noon.

It would have been much simpler if you had just acknowledged at the beginning that you were paid twice and kept the funds. We have given you ample time to show any evidence of any refund- a Paypal statement, a Paypal e-mail, anything. Unethical businessmen give eBay a bad name.
